Welcome to Local Clip. These Terms of Use (the “Terms”) govern access to the Local Clip marketing site (localclip.app), participation in the waitlist, and purchase or use of Local Clip software (collectively, the “Service”). By visiting the site, submitting your email, or starting a checkout you agree to these Terms. If you do not agree, please do not use the Service.
The Service is provided by Thomas Chaigneau, trading as chainyo.dev, an auto-entrepreneur registered in France under SIREN 920 550 845 (SIRET 920 550 845 00027, NAF 6202A). Contact us at thomas@chainyo.dev.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you confirm that you have the legal capacity to enter into a binding agreement.
2. License and acceptable use
- When you purchase Local Clip you receive a non-exclusive, non-transferable licence to install and use the desktop application on devices you own or control, solely for creating and exporting media derived from your own content.
- You may not reverse engineer, modify, decompile, or redistribute the software except where expressly permitted by law.
- You must not use Local Clip to infringe the rights of third parties, violate privacy, or produce illegal content.
- Automated scraping, stress testing, or attempts to bypass security controls on the website or API endpoints are prohibited.
3. Waitlist and communications
- Submitting your email to the waitlist authorises us to send you product updates and launch information.
- You can unsubscribe at any time by using the unsubscribe link in our emails or contacting thomas@chainyo.dev.
- We reserve the right to remove entries that appear fraudulent, abusive, or submitted with disposable addresses.
4. Purchasing, billing, and licences
- Checkout and license delivery are handled by Polar Software, Inc.. By purchasing you also agree to their customer and payment terms.
- Prices are shown inclusive of applicable VAT where required by law. VAT invoices are provided through Polar.
- Because Local Clip is a digital product delivered immediately, statutory withdrawal rights may be limited once you access the download. If you encounter issues please contact us — we will always try to help.
- Licences remain valid as long as you comply with these Terms and the licence scope indicated at purchase. We may revoke access if fees are unpaid or if the software is misused.
5. Intellectual property
All trademarks, logos, and content displayed on the site are owned by chainyo.dev or licensors. You may not use them without prior written permission. You retain ownership of the media you import into or export from Local Clip.
6. Feedback
If you share product ideas or suggestions you grant us a perpetual, irrevocable, royalty-free licence to use that feedback without obligation to you.
7. Availability and modifications
- We aim to keep the website and downloads available but do not guarantee uninterrupted access.
- Features, pricing, and system requirements may change over time. We may suspend or discontinue any part of the Service with reasonable notice when possible.
- We may update these Terms to reflect product or legal changes. The updated date will show when the latest version took effect. Continued use after changes means you accept the revised Terms.
8. Disclaimer
The Service is provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Processing of media files is performed locally on your device; you are responsible for backing up your content and ensuring it is lawful to use.
9. Limitation of liability
To the fullest extent permitted by law, chainyo.dev will not be liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits, data, or business arising from your use of the Service. Our aggregate liability is limited to the amount you paid for Local Clip in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be limited under French law.
10. Governing law and disputes
These Terms are governed by French law. If we cannot resolve a dispute amicably, you may bring the matter before the competent courts in Paris, France, or, where mandatory law grants you additional consumer protections, the courts of your place of residence.
